FCA South Africa (Proprietary) Limited, registration number 1997/014154/07 ("FCA" or "we" or "us" or "our") includes many different brands, namely Fiat, Fiat Professional Jeep, Alfa Romeo and Abarth. We are an automobile manufacturer who, including but not limited to, sell, provide services and parts for motor vehicles.

We understand the importance of protecting your privacy. This Privacy Policy sets out what we do with any personal Information we collect and process about you or that you provide to us, how we use and process this information, when you use the Website, the Mobile Application, our call centres, your attendance at our dealerships, or any other interaction with us.

In this Privacy Policy, “Personal Information" refers to any information which may be used to identify you or is held in association with information that can be used to identify you, including information such as your name and surname, date of birth, contact details (e.g. your home address, postal address, email address or phone number).

This Privacy Policy complies with the provisions of the Protection of Personal Information Act, 4 of 2013 (“the Act”) and represents our commitment to complying with its obligations under the Act.

Processing of Personal Information

Depending on how you use our services, we process your Personal Information through the www.fiat.co.za, www.jeep.co.za, www.fiatprofessional.co.za and www.alfaromeo.co.za sites (the "Website"), our Mobile Applications, our call centres, your attendance at our dealerships, or any other interaction with us which is lawful, reasonable, and relevant to our business activities, with the ultimate goal of improving our product and service offerings, the Website, the Mobile Application and your experience on the Website, Mobile Application and us in general.

We will always do our best to ensure that your personal information is treated securely and in accordance with this Privacy Policy.

Please note that when you use a third-party website or platform to provide us with your information, that information may also be collected and processed by that third-party. The Privacy Policy of the third-party will then apply to any information the third-party may collect. If our Website contains any links to other websites, we are not accountable for their Privacy Policies and practices as we do not control those websites.

We as the Responsible Party use the information we collect to provide, maintain, and improve the Website, to develop new services, and to protect us, our services and our users. By accepting these terms, we strive to improve our users' experience.

Sharing Information

As a company, we include many different brands (“Our Group”). We may share your personal information with other entities within our international group of companies, with companies providing a service to us or Our Group including agents and subcontractors, or with our dealers. However, such entities and persons will only use your personal information for the purposes set out above. Please note that, other than the third-parties listed above, we will not disclose your personal information to any other third-party whatsoever without your consent and we will never sell your personal information.

Once information has been shared with another company, that company is now the Responsible Party of that information and as such information falls under their Privacy Policy and practices.

Cross Border Flow of Information

We may share your Information with Our Group which means we will share your Personal Information to our international group in foreign countries.

We may transfer to and/or store your Information to companies for the purposes of collection provided in this Privacy Policy in Our Group in foreign countries. We will ensure that such jurisdictions have adequate levels of protection with regards to the protection of Personal Information or data legislation. If the location that Information is transferred to or stored does not have substantially similar laws which provide for the protection of Personal Information, we will take the legally-required steps to ensure that your Personal Information is adequately protected in that jurisdiction.

In order to ensure the protection of your privacy and Personal Information when transferring and storing your information, we will only do so if we have your consent and are bound by contract.

When you use social media forums such as Facebook, Twitter, Pinterest, Instagram, LinkedIn, etc., it is important to familiarise yourself with how these forums allow you to share your data and personal information. We take all reasonable steps to make sure any information and/or content on our Website and/or App is correct and clear. However, we make no representations or warranties (express or implied) as to the functionality, standard, availability, accessibility, and accuracy of our Website and/or App or any correctness of content and information of our Website and/or App. We will not be bound if any representations or warranties are made on our Website and/or App or by our representatives.

If any provision of this Privacy Policy is judged to be illegal, void or unenforceable due to applicable law or by order of a court of a competent jurisdiction the offending provision shall be deemed severable from the remaining terms of this policy and deleted. The unaffected portions of this Policy will continue to be in full force and effect and the remainder of the provisions will not be prejudiced.
